To the maximum extent permitted by law, Canada Digital Insights will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your access to or use of (or inability to access or use) the Site or Content.
To the maximum extent permitted by law, in no event will Canada Digital Insights’ total liability to you for all claims arising out of or relating to the Site or these Terms exceed the lower of: (a) the amount you paid to Canada Digital Insights for use of the Site in the twelve (12) months preceding the event giving rise to the claim, or (b) €100. For clarity, the Site is currently provided without a purchase requirement, so this cap will generally be €100 where applicable.
Some jurisdictions do not allow certain limitations of liability. Where such limits are not permitted, our liability will be limited to the maximum extent permitted by applicable law.
8) Indemnification
You agree to defend, indemnify, and hold harmless Canada Digital Insights, its operators, and contributors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) your misuse of the Site; or (c) your infringement of any intellectual property or other rights of any person or entity.

Our Privacy policy explains how we collect, use, and protect personal information, and how cookie preferences are handled on this Site. The Privacy policy is incorporated into these Terms by reference. If you do not agree with our Privacy practices, do not use the Site.
11) Governing law and jurisdiction
These Terms and any dispute or claim arising out of or relating to them, the Site, or the Content will be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Subject to the Dispute Resolution section below, you agree that the courts located in Toronto, Ontario will have exclusive jurisdiction to resolve any dispute or claim arising out of or relating to these Terms or your use of the Site, and you submit to the personal jurisdiction of such courts.
12) Dispute resolution (informal first)

We may also restrict access to certain features to protect the Site’s integrity and availability.
The sections of these Terms that by their nature should survive termination will survive, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, and Dispute Resolution.
14) Modifications to these Terms
We may update these Terms from time to time to reflect changes to the Site, legal requirements, or operational practices.
